Treasurer Report: Alison
was not present. A current treasurer’s report will be given at the March 2012 meeting.
November 2011 Minutes: Were not approved. They
will need to be approved at the March 2012 meeting along with the January 2012
minutes.
Sally
Wallace, director of Shepherd of the Hills Preschool shared with us her
personal experience of being visited and investigated by the US Department of
Labor, Wage and Hour Division. This was
an extensive investigation in which all employee records, employees and
administrators were interviewed. Sally
was told that the federal government was “targeting” early childhood centers in
order to assure they were in compliance with all of the Fair Labor Standards
Act.
A
few highlighted items from the investigation:
· All early childhood teachers, assistant teachers, and aides can not be exempt, salaried employees. They must be categorized as no-exempt and paid hourly including overtime pay when applicable.
· If your staff is issued a contract when beginning employment, it must state non-exempt, hourly pay, to include overtime pay were applicable.
· Directors and licensed Colorado Certified Elementary Education teachers can be salaried - exempt, IF they work 40 hours per week. Assistant Director’s can be salaried – exempt if they work 40 hours per week. If they are scheduled less than 40 hours per week they too must be non-exempt and hourly.
· All non-exempt employees must log their hours daily, and turn in a time sheet weekly. These time sheets must be retained for a minimum of three years.
· Anytime that your teachers or aides are working outside of school hours (ie: planning, prep-work, meetings, programs, room set-up or take down, etc.) they must clock that time and be compensated for those hours.
· As the Director listed on your center’s license, you are held responsible for assuring that all of the FLSA laws are followed. Even if your school is owned and housed in a church. You are the responsible party and could be fined for not adhering to these laws.
